The Ingham County Drain Commissioner (“ICDC”) has determined that a portion of the Drain Easement held by the Bolter Drain Drainage District, a public body corporate (“Drainage District”) established pursuant to the Michigan Drain Code of 1956, 1956 P.A. 40, as amended, MCL 280.1 et seq., (“Drain Code”), as amended, is no longer necessary for drainage purposes. The ICDC proposes to release, convey and abandon all of its rights, title and interests in a portion of the Bolter Drain easement (“Drain Easement”), dated November 29, 1907, and recorded on June 23, 1955 Liber 61, Page 142, Ingham County Register of Deeds, to the fee owner of the property herein described in accordance with Section 6 of the Drain Code, MCL 280.6.

 

            The portion of the Drain Easement to be released, conveyed, and abandoned is located over and across the following land in the City of Lansing, County of Ingham, State of Michigan, described herein:

Parcel Description: Part of the Kahres Farm No. 2 Plat, a subdivision on part of the East ½ of Section 9 and the West ½ of Section 10, T3N, R2W, City of Lansing, Ingham County, Michigan, more particularly described as commencing at the northwest corner of Lot 16, thence southwesterly along the south line Edgewood Blvd 66 feet, thence southeasterly along the east line of vacated Edgewood Circle 200.01 feet, thence southwesterly parallel with Edgewood Blvd 510.49 feet, thence north perpendicular to said Edgewood Blvd 200 feet, thence southwesterly along said Blvd 66 feet, thence southwesterly perpendicular to said Blvd 146.7 feet, thence south 435.92 feet to the north line of I-96, thence southeasterly along highway 963.95 feet to the southeast corner of lot 14, thence northeasterly on the easterly line of said Lot 14 and said Lot 14 extended 566.68 feet to the southerly line of Lot 15, thence northeasterly 85.69 feet to the southeast corner of Lot 15, thence northeasterly on the easterly lines of Lots 15 and 16 444.62 feet, thence southwesterly parallel with Edgewood Blvd 333.42 feet to the easterly line of vacated Edgewood Circle, thence northwesterly along the west line of Lot 16 252.97 to the beginning.             In accordance with Section 6 of Act 40 of the Public Act of 1956, as amended, at the office of the Ingham County Drain Commissioner, 707 Buhl Avenue, Mason, Michigan 48854, on September 22, 2025, from 8:00 a.m. to 5:00 p.m., the Drain Commissioner shall meet upon this proposed release of a portion of the Drain Easement and any taxpayer may appear to protest said release.

 

            After said date, the Drain Commissioner may release and convey the above-described portion of the Drain Easement to the fee owner on behalf of the Bolter Drain Drainage District.
