So to speculate, 2 separate persons go out to commit a crime one with a gun and one without a gun? Just saying if I go with a gun isn't my intent whether I use it or not during the crime still different than the person without a gun?

2nd situation 2 separate persons go to a party, neither planning on committing any crime, yet one is carrying a gun the other isn't... The party becomes loud attracts police because neighbors have called in complaints and the police come on the scene, even though the one person does NOT display or use aggression while carrying the gun AND also NOTES they have a gun are they arrested and charged with a crime (I understand the who permit to carry a concealed weapon -which could also impact verses open carry.

/ At the same time I have seen how police in many instances react to a person who notes(clearly verbally says I have a gun) they are carrying a gun and have been KILLED/SHOT on the spot.... Just so much to clarify. Also When is it or is it not a Felony, doesn't this STILL leaves the situation and person carrying a gun open to prejudicial treatment...Doesn't this still leave persons of color more open to a Felony charge?? (just bases on what I read in this article and what I've seen in the News) Thank you for letting me comment.
